By accessing kreashionsoftwarehouse.com or engaging Kreashion Software House (“Kreashion”, “we”, “us”) for services, you agree to these Terms of Service. If you do not agree, please do not use the website or our services.
1. Website use
You may use this website for lawful purposes only. You agree not to interfere with the site's operation, attempt unauthorized access, scrape content at scale, or use the site to transmit malware or unlawful material. All content on this website — including text, logos, design, and code samples — belongs to Kreashion or its licensors and may not be reproduced without written permission.
2. Services and statements of work
Website content, including service descriptions, pricing indications, timelines, and case studies, is informational. Every engagement is governed by a separate proposal or statement of work (SOW) signed by both parties. In the event of a conflict between these terms and a signed SOW, the SOW takes precedence for that engagement.
3. Client responsibilities
Clients are responsible for providing timely access to required accounts, data, credentials, and feedback, and for ensuring that materials they supply (content, data, trademarks) do not infringe third-party rights. Delays in client inputs may shift delivery timelines accordingly.
4. Fees and payment
Fees, milestones, and payment schedules are defined in the applicable SOW. Unless stated otherwise, invoices are due within 14 days of issue. Taxes are the client's responsibility unless a valid exemption is provided. Work may be paused on accounts that are more than 30 days overdue.
5. Intellectual property
Upon receipt of final payment, the client receives full ownership of the custom deliverables created for the engagement, as defined in the SOW. Kreashion retains ownership of its pre-existing tools, libraries, frameworks, and internal know-how, and reserves the right to reuse non-client specific components. Unless otherwise agreed in writing, we may not publicly identify the client or display the work in our portfolio without permission.
6. Confidentiality
Each party will protect the other's confidential information with at least the care it uses for its own, and will use it only for the purposes of the engagement. Obligations survive for three years after the relationship ends, or indefinitely for trade secrets.
7. Warranty and support
We warrant that services will be performed professionally and materially in accordance with the SOW. Any warranty period, maintenance plan, or service-level agreement (SLA) is defined in the SOW. Except as expressly stated, the website and services are provided “as is” without warranties of any kind, whether express or implied.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and Kreashion's total aggregate liability arising out of an engagement is limited to the fees actually paid by the client for that engagement in the twelve months preceding the claim.
9. Termination
Either party may terminate an engagement as set out in the SOW, typically with written notice and payment for work completed up to the termination date. Provisions concerning payment, confidentiality, intellectual property, and liability survive termination.
10. Governing law
These terms are governed by the laws of Pakistan. Any disputes shall first be attempted to resolve amicably through negotiation; failing that, the competent courts of Pakistan shall have jurisdiction.
11. Changes to these terms
We may revise these terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
